I live in CA. I was Arrested For Dui. Blood test result is only 0.07.?

Please let me know what are the next legal steps that I need to take. Do I still have to appear in court, get a Lawyer help etc. Thanks

There are actually two separate code sections in CA that deal with DUI. There’s vehicle code 23152(a), which prohibits Driving Under The Influence, and 23152(b), which prohibits driving with a .08 blood alcohol content. Obviously, 23152(b) is much easier to prove, provided a blood test actually shows .08. 23152(a) requires circumstantial evidence.

If you were arrested, and released, you need not do anything. Wait to see if you are actually charged. Often, without a conclusive blood test, DA’s will decline to file Dui Charges. Either way, you’ll get a letter in the mail notifying you of the DA’s decision.
